Terms of Service

1. Who we are
Frolic (the “Service”) is an event discovery platform for the Denver metro area, operated by Skylark Creations (“we”, “us”). Contact: hello@frolic.town.
2. Accepting these terms
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
3. What the Service does
Frolic aggregates publicly listed events from third-party sources, ranks them, and provides AI-assisted search and recommendations. Frolic does not organize, host, or sell tickets to the events you discover through the Service.
4. Accounts and acceptable use
- You must be 13 or older to create an account.
- Keep your email account secure; Frolic uses passwordless magic-link sign-in.
- Do not abuse the Service: no scraping at scale, reverse engineering, impersonation, harassment, or illegal activity.
- Do not use the Service to infringe others' rights or submit unlawful content.
5. Subscriptions, billing, and refunds
- Premium is offered at $7/month or $60/year, billed via Stripe. Prices are in USD and may change with at least 30 days' notice for existing subscribers.
- Subscriptions renew automatically at the end of each billing period. You can cancel anytime from your account settings; access continues through the end of the period you paid for.
- Frolic does not generally offer refunds for partial periods. If you believe you have been charged in error, contact hello@frolic.town.
- If a payment fails, Premium features may be suspended until payment is resolved.

6. Event information and accuracy
Event details (dates, prices, addresses, descriptions) are sourced from third parties and may be incomplete or out of date. Always verify critical details with the event organizer before you go. Frolic is not responsible for event cancellations, changes, or the conduct of organizers or other attendees.
7. AI-generated content
Frolic's AI Chat concierge and recommendations are generated by language models and may occasionally be inaccurate. Treat AI output as a suggestion, not a guarantee. Do not rely on it for safety-critical decisions.
8. Your content
You retain ownership of anything you submit (e.g., chat messages, preferences). You grant Frolic a limited, worldwide, royalty-free license to use that content as needed to operate the Service for you.
9. Termination
You may close your account at any time. Frolic may suspend or terminate accounts that violate these Terms or that pose a risk to the Service or other users. On termination, your personal data is handled as described in the Privacy Policy.
10. Disclaimers and limitation of liability
The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Frolic and Skylark Creations are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months preceding the claim.

11. Governing law
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law rules.
Confirm jurisdiction and any arbitration or venue clauses with counsel.
12. Changes to these terms
Frolic may update these Terms from time to time. If changes are material, account holders will be notified by email. Continued use of the Service after an update constitutes acceptance of the new Terms.
